Terms and Conditions
1.0 Contract
1.1 The Terms & Conditions below form a legal agreement between you, referred to as You or the Potential Nanny or Nanny Candidate, and Educare Nannies Pty Ltd (ACN 666 924 278), referred as Educare Nannies®.
1.2 By completing the Application Form on the Educare Nannies website at www.educarenannies.com you’re immediately accepting and agreeing to these Terms & Conditions. You may also accept these Terms and Conditions in another way, for example, verbally to an Educare Nannies representative, by emailing Educare Nannies or by otherwise engaging Educare Nannies.
1.3 In these Terms & Conditions:
Potential Nanny, Nanny Candidate and You means the person accepting these Terms & Conditions.
Potential Nanny is any person within Educare Nannies’ network or that Educare Nannies advertises to in order to fill a role sought by the Client.
A Nanny Candidate is any person that is recommended or introduced by Educare Nannies to the Client, whether engaged or used by the Client or not.
Educare Nannies means Educare Nannies Pty Ltd (ACN 666 924 278)
Client refers to individuals, families, or employers utilizing the services provided by Educare Nannies®.
1.4 These Terms & Conditions are legally binding on the Potential Nanny or Nanny Candidate.
1.5 Providing false, incomplete, inaccurate, or illegal information to Educare Nannies is not allowed and could lead to legal action.
2.0 Candidate Responsibilities
2.1 Candidates must complete the full recruitment process by registering on the Educare Nannies® website and undergoing an interview, reference checks, police vetting, and providing appropriate identification documents. Additionally, candidates must possess a current Provide First Aid certificate.
2.2 Candidates are prohibited from entering private arrangements with Clients introduced to them via Educare Nannies®. Any breach of this rule will result in fees being applied to both the Candidate and the Client, and both parties will be removed from our services.
2.3 It is mandatory for Candidates to hold a current Provide First Aid Certificate (including unit standard HLTAID003 or HLTAID011 and HLTAID009) before caring for children, or they must have booked a course to obtain one.
2.4 Candidates acknowledge that they are solely responsible for the children under their care during their shift and must never leave a child alone or unattended under any circumstances.
2.5 Candidates must always show respect for the property and privacy of Educare Nannies® Clients, leaving the environment as they found it or tidying/cleaning up as necessary.
2.6 Candidates are not permitted to use the Client’s private phone unless it is an emergency.
2.7 During their shift, Candidates must engage appropriately with the children and refrain from using their personal phone, except in cases of emergency.
2.8 In the event of a dispute between the Candidate, Client, or Educare Nannies® Agency, the Candidate must refrain from contacting the Client, and all communication regarding the dispute must be between the Candidate and Educare Nannies® Agency only.
2.10 Confidentiality must be maintained in all communications between the Agency, Client, and Candidate.
2.11 Tax obligations are the responsibility of the Candidate, as Educare Nannies® is a Nanny agency, not an employer. Candidates are advised to contact the ATO to understand their tax obligations.
2.12 Candidates are required to prioritize health and safety in their work environment, reporting any hazards, illnesses, accidents, injuries, or near-misses to the Client and/or Educare Nannies® promptly. Additionally, Candidates must respect the property and privacy of Clients, refraining from photographing children or property without consent, posting information or photographs on social media, or sharing any Client information with third parties.
3.0 Candidate Safety Guidelines
3.1 Upon arrival at the placement, it is essential for the Candidate to clearly understand and feel comfortable with any requests from the Client.
3.2 Ensuring the safety of our Candidates is a top priority at Educare Nannies®. We strive to ensure that Candidates always feel secure and protected. In the unlikely event that a Candidate feels threatened or unsafe during a booking/placement, immediate support is available by contacting Educare Nannies®.
3.3 Candidates are encouraged to store the Educare Nannies® contact number (0422 725 021) in their phone for quick access during a booking or in case of an emergency.
4.0 Casual Nanny Responsibilities
4.1 Educare Nannies® reserves the right to revoke a Candidate’s registration for any serious misconduct, including but not limited to, failure to attend a booking, sleeping while on duty, showing disrespect or abuse towards the child(ren) or Client property, or violation of the Terms & Conditions.
4.2 Casual Nanny must contact the family within 24 hours (or sooner for emergency bookings) of accepting a booking to introduce themselves and confirm the start and finish time, address/location, and directions if necessary.
4.3 Rates are determined by Educare Nannies®; they are non-negotiable for Casual Nanny Candidates. Please refer here for current rates. Casual Nanny Candidates must confirm the hourly rate with the Client at the end of the booking (minimum of 4 hours).
4.4 Casual Nanny must arrive at the booking location before the scheduled start time.
4.5 Casual Nanny must honor any accepted bookings, except in cases of emergency.
4.6 In the event that a Casual Nanny is unable to fulfill a booking, they must provide appropriate notice (within 24 hours).
4.7 Casual Nanny Candidates agree to provide care exclusively at the agreed-upon premises unless express permission is granted by the Client (e.g., taking the child on an outing to the park).
5.0 Casual Nanny Safety
5.1 Upon arrival at the casual nanny booking, it is essential for the Casual Nanny to clearly understand and feel comfortable with any requests from the Client.
5.2 Ensuring the safety of our Casual Nannies is a top priority at Educare Nannies®. We strive to ensure that Candidates always feel secure and protected. In the unlikely event that a Casual Nanny feels threatened or unsafe during a booking/placement, immediate support is available by contacting Educare Nannies®.
5.3 Casual Nannies are encouraged to store the Educare Nannies® contact number (0422 725 021) in their phone for quick access during a booking or in case of an emergency.
5.4 Casual Nanny Candidates are encouraged to inform a friend or relative of their whereabouts, activities, and expected return time when on a job.
6.0 Cancellation of a Casual Nanny Booking – by a Casual Nanny
6.1 If a Casual Nanny needs to cancel a job they have accepted, they must inform Educare Nannies® at least 72 hours prior to the scheduled job, allowing adequate time for finding a replacement Casual Nanny.
6.2 In the event of a cancellation within 24 hours of the job start time, the Casual Nanny is required to notify both Educare Nannies® and the Client directly. This courtesy call to the Client is essential.
6.3 Once a Casual Nanny has confirmed a Casual Nanny booking, they are obligated to honor their commitment to both the Client and Educare Nannies®. This adherence is vital for upholding the reputation of Educare Nannies® and the collective integrity of its team members.
7.0 Terms & Conditions for Nanny Positions (Short and Long-Term)
7.1 If a Nanny Candidate has been recommended for any nanny positions by Educare Nannies®, they are required to notify Educare Nannies® how their interview with the client went, keep us informed of all communication, and inform us if they are offered employment.
7.2 Candidates are covered by Educare Nannies® Public & Statutory Liability insurance, except in cases involving the use or transport of the Client’s vehicle, for which Candidates must ensure they are covered by the Client’s car insurance policy.
8.0 Liability, warranties and indemnities
8.1 By utilising the services of Educare Nannies® , the Candidate, explicitly grants permission for Educare Nannies® to gather and publicise information as outlined in these Terms and Conditions. The Candidate also expressly waives any rights, whether statutory or common law, to take legal action against Educare Nannies® due to the publication of such information, irrespective of the Candidate’s perception of its fairness and accuracy.
8.2 The Educare Nannies® website may feature links to third-party advertisements and sites. Accessing any other Internet site linked to the Educare Nannies® website is undertaken at the Candidate’s own risk. Educare Nannies® assumes no responsibility for the accuracy or reliability of any information, opinions, or statements presented in third-party advertisements or on third-party sites.
8.3 The Candidate will indemnify Educare Nannies® against any claims arising from the Candidate’s interactions with, or treatment of, a Client, regardless of the circumstances.
8.4 Educare Nannies® Agency retains the right to modify these Terms & Conditions at any time.
9.0 Privacy
9.1 Please view our privacy policy.
10.0 Disputes
10.1 If any dispute arises, you agree to notify our Head Office via email at info@educarenannies.com or call us at 0422 725 021 with comprehensive details of the dispute, and attempt to resolve the dispute with Educare Nannies®, prior to taking any action.
10.2 All communication regarding any dispute between the Candidate and Educare Nannies® must be exclusively between the Candidate and Educare Nannies® The Candidate agrees not to disclose the details of any such dispute with any other person, including any Clients.
11.0 Copyright and Trademarks
11.1 The content featured on the Educare Nannies® website, including text, graphics, images, HTML codes, and other materials (referred to collectively as the “Material”), are safeguarded by Australian and international copyright laws. They remain the sole property of Educare Nannies®
12.0 Governing Law
12.1 These Terms & Conditions shall be governed by the laws of the state of New South Wales, and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
